Terms of Use

These Terms of Use ("Terms") constitute a legally binding agreement between you and Haya Al Alfalah Community ("we", "us", "our") governing your access to and use of the Haya Al Alfalah Community Platform, including all features, content, tools, and services accessible through it (collectively, the "Platform").

By accessing the Platform, submitting a membership application, creating an account, or using any feature of the Platform, you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy, which is incorporated herein by reference.

If you do not agree to these Terms, you must not use the Platform. If you are using the Platform on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.

To register as a member and access the full features of the Platform, you must:

• Be at least 18 years of age. Individuals under 18 may participate in specific community programs (such as educational classes) under the account of a parent or guardian who accepts these Terms on their behalf.
• Submit a membership application that is reviewed and approved by our admin team. Membership is not automatic and may be declined at our discretion.
• Provide accurate, truthful, and current information during registration and keep it up to date.
• Have the legal capacity to enter into a binding agreement under the laws of Pakistan or the laws of your country of residence.
• Not have been previously suspended or banned from the Platform.

Guests (non-registered visitors) may view public content on the Platform but may not participate in projects, access the resource library, post in the forum, or use any member-only features.

When you are approved as a member, you will be issued an account on the Platform. You are responsible for your account as described below.

Haya Al Alfalah is a faith-based community grounded in Islamic ethics. By joining, you commit to upholding the values of adab (courtesy and respect), sidq (truthfulness), amanah (trustworthiness), and ihsan (excellence in conduct) in all your interactions on the Platform.

You agree to treat all members (regardless of background, nationality, or level of religious practice) with the dignity and respect owed to every human being. Disagreement is welcome; disrespect is not.

These values are not aspirational suggestions. They form part of your binding agreement with us. Conduct that falls short of this standard is grounds for moderation action as described in Section 11.

The Platform is provided for community collaboration, education, resource sharing, and communication between members. You agree to use it only for these purposes and in accordance with these Terms.

The following conduct is strictly prohibited on the Platform. Violation of these rules may result in immediate suspension or permanent removal of your account, and in serious cases may be referred to the appropriate authorities.

You retain full ownership of the content you post, upload, or share on the Platform ("Your Content"). By submitting Your Content, you grant Haya Al Alfalah Community a non-exclusive, royalty-free, worldwide license to store, display, reproduce, and distribute Your Content solely for the purpose of operating the Platform and delivering community services to members.

This license does not give us the right to sell Your Content, use it for advertising, or share it outside the Platform without your consent. The license terminates when you delete your content or close your account, subject to any content that has been shared with other members or posted publicly.

You are solely responsible for Your Content. By posting content you represent and warrant that:

• You own the content or have all necessary rights and permissions to post it
• The content does not infringe the copyright, trademark, privacy, or other rights of any third party
• The content does not violate any applicable law or these Terms
• The content is accurate and not misleading

The Platform itself (including its design, code, branding, logos, and all content created by Haya Al Alfalah) is owned by or licensed to us and is protected by applicable intellectual property laws. You may not copy, reproduce, distribute, or create derivative works from Platform content without our written permission.

Linking to public pages of the Platform for community or educational purposes is permitted. Deep-linking to internal resources or scraping content is not.

If you believe that content on the Platform infringes your copyright, please send a written notice to legal@hayaalfalah.com including: identification of the work claimed to be infringed, the location on the Platform where the infringing material appears, your contact information, and a statement of good faith belief that the use is not authorized.

Community projects are the core of what we do. Participation in projects is subject to the following additional terms:

The community forum is powered by phpBB and is an extension of this Platform. The same standards of conduct apply in the forum as across the rest of the Platform. Additional forum-specific rules are as follows:

Your use of the Platform is also governed by our Privacy Policy, which is incorporated into these Terms by reference. The Privacy Policy explains what data we collect, how we use it, and your rights regarding your personal data.

In addition to the Privacy Policy, you agree not to:

• Collect, harvest, or store personal data of other members without their explicit consent
• Share another member's personal information outside the Platform without their consent
• Use member contact details obtained through the Platform for unsolicited communications
• Photograph or record community events and share images identifying other members without their consent

We reserve the right to take any of the following actions, at our sole discretion, in response to violations of these Terms or conduct we deem harmful to the community:

If your account is suspended or content is removed and you believe this was done in error, you may appeal within 14 days by emailing legal@hayaalfalah.com with the subject line "Moderation Appeal". We will review your appeal within 10 business days and inform you of the outcome. Our decision on appeal is final.

You may close your account at any time by contacting us at legal@hayaalfalah.com. Account closure results in deactivation of your access. Personal data will be handled in accordance with our Privacy Policy. Note that content you have posted publicly or in shared project spaces may be retained for community record purposes.

Upon account suspension or closure (whether initiated by you or by us) your right to access the Platform immediately ceases. Clauses that by their nature should survive termination (including Sections 7, 12, 13, and 14) will remain in full force.

The Platform is provided "as is" and "as available" without warranties of any kind, express or implied. To the fullest extent permitted by law, we disclaim all warranties including but not limited to:

• Fitness for a particular purpose or uninterrupted, error-free operation
• The accuracy, completeness, or reliability of any content posted by members
• The suitability or quality of any advice, information, or resources shared by members
• That the Platform will be free from viruses or other harmful components

We do not endorse or take responsibility for the views expressed by members in the forum, project updates, or any other user-generated content on the Platform.

To the fullest extent permitted by applicable law, Haya Al Alfalah Community, its administrators, moderators, and volunteers shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from:

• Your use of or inability to access the Platform
• Any content posted or shared by members
• Unauthorized access to or alteration of your data (except where caused by our negligence)
• Actions taken in connection with investigations of suspected violations of these Terms
• Technical failures, interruptions, or data loss

Where liability cannot be excluded by law, our total aggregate liability to you in connection with the Platform shall not exceed the greater of (a) the amount you have paid us in the 12 months preceding the claim, or (b) PKR 5,000 (five thousand Pakistani Rupees).

Nothing in these Terms excludes or limits liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any liability that cannot be excluded or limited under applicable law.

We may update these Terms from time to time to reflect changes in the law, our services, or our community standards. The "Last updated" date at the top of this page will always reflect the most recent version.

If we make changes that materially affect your rights or obligations, we will:

• Post a prominent notice on the Platform for at least 14 days before the changes take effect
• Send a notification to all active members via the platform notification system
• Email all registered members at the address on their account

If you continue to use the Platform after the effective date of the updated Terms, you will be deemed to have accepted the changes. If you do not accept the updated Terms, you must stop using the Platform and may request account closure.

Minor changes (such as clarifications, typographical corrections, or administrative updates that do not affect your rights) may be made without notice.
